The Health and Social Care Act 2008 (Regulated Activities) Regulations 2014 covers the safe care and treatment of service users, in the Section 12 1(c) the Act states the duty of ensuring that persons providing care or treatment to service users have the qualifications, competence, skills and experience to do so safely.
Employers have a duty of care to their healthcare workers and need to provide suitable and sufficient instruction, information and mandatory training. This is to ensure that the workforces are competent to carry out the activities of their role. The employer also has to ensure that healthcare workers remain competent by providing refresher training at appropriate intervals.
